DISPUTE RESOLUTION & MANDATORY ARBITRATION AGREEMENT

Informal Resolution First
In the interest of resolving disputes quickly and at a lower cost, you and Studio Be Napa LLC agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating any formal legal or arbitration proceeding. Binding Arbitration If the dispute cannot be resolved informally, you explicitly agree that any and all disputes, claims, or controversies arising out of or relating to your use of this website, booking platforms (including Momence), studio attendance, or physical/energetic services, shall be settled exclusively by binding, individual arbitration rather than a court of law.

Waiver of Class Actions and Jury Trials
YOU AND STUDIO BE NAPA LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, you waive your right to a trial by jury. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.Governing Law & LocationThis Arbitration Agreement shall be governed by, and interpreted in accordance with, the laws of the State of California. Any arbitration hearing, mediation, or legal proceeding that is not legally preempted by arbitration shall take place exclusively in Napa County, California. The arbitration will be administered by the American Arbitration Association (AAA) or JAMS under their applicable commercial rules.
